1. Acceptance of Terms

By downloading, installing, or using SkeeterBeater ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

SkeeterBeater is a mobile application that provides:

• High-frequency audio generation (15-20 kHz)
• Visual displays simulating bug zapper appearance
• Motion-activated interactive features
• Educational content about mosquito science

The App is provided for entertainment and educational purposes only.

3. Entertainment Disclaimer

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

• SkeeterBeater is NOT a mosquito repellent device
• The App makes NO claims of effectiveness in repelling, deterring, or controlling mosquitoes
• iPhone displays CANNOT emit true ultraviolet (UV) light wavelengths
• Scientific research shows UV light is only a secondary attractant for mosquitoes
• You should NOT rely on this App for protection against mosquito bites or mosquito-borne diseases
• For actual mosquito protection, use EPA-registered repellents, mosquito nets, or other proven methods

4. Health and Safety Warnings

4.1 Audio Warnings

• High-frequency sounds may cause discomfort in some individuals
• Some users may be more sensitive to ultrasonic frequencies
• Use at moderate volume levels
• Discontinue use if you experience discomfort, headaches, or ear pain

4.2 Visual Warnings

• The App contains flashing lights and pulsing visual effects
• These effects may trigger seizures in people with photosensitive epilepsy
• Users with a history of seizures should consult a physician before use
• Animations can be disabled in the App settings

4.3 Motion Detection

• When using motion detection features, ensure you have a firm grip on your device
• Be aware of your surroundings when swinging your device
• We are not responsible for damage to devices or injury resulting from motion-activated features

4.4 Pets

• High-frequency sounds may be audible to pets (dogs, cats, etc.)
• Monitor pets for signs of discomfort
• Consider using lower frequencies or muting audio around sensitive animals

5. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on iOS devices you own or control.

6. Restrictions

You agree NOT to:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any commercial purpose without our written consent
• Use the App in any way that violates applicable laws
• Claim or market the App as an actual mosquito repellent device

7. Intellectual Property

The App and all its contents, features, and functionality are owned by SkeeterBeater and are protected by copyright, trademark, and other intellectual property laws. The scientific research referenced in the App belongs to their respective authors and institutions.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• EFFECTIVENESS IN REPELLING MOSQUITOES OR ANY OTHER INSECTS

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SKEETERBEATER, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any mosquito bites or mosquito-borne diseases
• Any physical injury or property damage
• Any damages resulting from your use or inability to use the App

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App (which is zero, as the App is free).

10. Indemnification

You agree to indemnify and hold harmless SkeeterBeater and its developers from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any claim that your use of the App caused damage to a third party

11. Third-Party Links

The App may contain links to third-party websites or resources (such as charity organizations). We are not responsible for the content, products, or services offered by third parties. Your interactions with third parties are solely between you and them.

12. Updates and Changes

We may update the App from time to time. We may also modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason. Upon termination, your license to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SkeeterBeater regarding your use of the App.
